1 2 (b) Section 103 (b) of the Civil Rights Act of 1957 2 (42 U.S.C. 1975b (b)) is amended by striking out "the 3 provisions of the Travel Expenses Act of 1949, as amended 4 (5 U.S.C. 835-42; 63 Stat. 166)" and inserting in lieu 5 thereof the following: "subchapter I of chapter 57 of title 5 6 of the United States Code". 7 SEC. 3. (a) Section 104 of the Civil Rights Act of 1957 8 (42 U.S.C. 1975c) is amended 9 10 11 12 13 14 15 16 17 18 19 20 21 22 (1) in each of subsections (a) (1) and (a) (2), by inserting "age, handicap," after "sex,"; (2) in each of subsections (a) (3) and (a) (4), by inserting ", age, handicap," after "sex"; (3) in subsection (a) (2) by inserting "discrimina tion or" before "a denial"; (4) in each of subsections (a) (3) and (a) (4), by inserting "discrimination or" before "denials"; (5) by redesignating paragraph (6) of subsection (a) as subsection (b); (6) by redesignating subsections (b) and (c) as (c) and (d), respectively; and (7) by adding at the end the following: "(e) As used in this section, the term 'handicap' means, 23 with respect to an individual, a circumstance that would 24 make that individual a handicapped individual as defined in 23-2880-78 38 3 1 the second sentence of section 7 (6) of the Rehabilitation Act 2 of 1973 (29 U.S.C. 706 (6)).' 3 (b) Subsection (b) (which is redesignated as subsec 4 tion (c) by this Act) of section 104 of the Civil Rights Act 5 of 1957 (42 U.S.C. 1975c (b)) is amended by striking out 6 "fiscal year 1978" and inserting in lieu thereof "the fiscal 7 year ending September 30, 1983". 8 SEC. 4. Section 105 (a) of the Civil Rights Act of 1957 9 (42 U.S.C. 1975d (a)) is amended by striking out “and 10 who shall receive compensation at a rate, to be fixed by the 11 President, not in excess of $22,500 a year”. 12 SEC. 5. Section 105 (c) of the Civil Rights Act of 1957 13 (42 U.S.C. 1975d (c)) is amended by striking out "com14 posed of citizens of that State and" and inserting in lieu 15 thereof the following: "as it deems advisable but the Com16 mission shall constitute at least one such advisory committee 17 within each state. The Commission". 18 Sec. 6. Section 105 (d) of the Civil Rights Act of 1957 19 (42 U.S.C. 1975 (d)) is amended by striking out "sections 20 281, 283, 284, 434, and 1914 of title 18 of the United 21 States Code, and section 190 of the Revised Statutes" and 22 inserting in lieu thereof the following: "sections 203, 205, 23 207, 208, and 209 of title 18 of the United States Code". 24 SEC. 7. Section 106 of the Civil Rights Act of 1957 25 (42 U.S.C. 1975e) is amended to read as follows: 1 2 4 "AUTHORIZATION OF APPROPRIATIONS "SEC. 106. There are authorized to be appropriated such 3 sums as are necessary to carry out the provisions of this 4 Act.". 95TH CONGRESS 2D SESSION S. RES. 456 IN THE SENATE OF THE UNITED STATES MAY 17, 1978 Mr. BAYH submitted the following resolution; which was referred to the Committee on the Budget RESOLUTION Waiving section 402 (a) of the Congressional Budget Act of 1974 with respect to the consideration of S. 3067, the Civil Rights Commission Act of 1978, a bill to authorize appropriations for the United States Commission on Civil Rights, and for other purposes. 1 Resolved, That, pursuant to section 402 (c) of the Con2 gressional Budget Act of 1974, the provisions of section 3 402 (a) of such Act are waived with respect to the con4 sideration of S. 3067, a bill to extend the Commission for 5 five years, to authorize necessary appropriations for the 6 Commission, to effect certain changes to comply with other 7 changes in the law, and for other purposes. Such waiver 8 is necessary in order to insure that the Commission on Civil 2 1 Rights will be able to carry out its statutory duties during 2 the fiscal year 1979. The moneys to be appropriated are 3 sufficiently small that the consideration of S. 3067 will not 4 significantly affect the congressional budget. That while the 5 Committee on the Judiciary has engaged in a substantial 6 effort to consider the bill beginning in December 1977, there 7 is sufficient reason to believe that the committee will not 8 report the bill during the present Congress. Thus, both the 9 committee and the Senate will be prevented from com10 plying with the Congressional Budget Act with respect to 11 the May 15 deadline and from giving timely attention to the 12 authorization of appropriations for the United States Com13 mission on Civil Rights. |
